1. Agreement to Terms
By accessing or using LaunchBuddy's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Services
LaunchBuddy provides website design, development, hosting, and maintenance services for small businesses. Our services include:
- Custom website design and development
- Managed website hosting
- Ongoing website maintenance and updates
- Technical support
3. Pricing and Payment
- All prices are quoted in Canadian Dollars (CAD) unless otherwise specified.
- One-time setup fees are due upon project commencement.
- Monthly care plan fees are billed in advance on a recurring basis.
- We accept major credit cards and e-transfer payments.
- Late payments may result in service suspension after a grace period.
4. Client Responsibilities
As a client, you agree to:
- Provide accurate and complete information for your project
- Provide timely feedback and approvals during the design process
- Ensure you have rights to all content you provide (images, text, logos)
- Maintain accurate billing information
- Not use our services for illegal or harmful purposes
5. Intellectual Property
- Upon full payment, you own the custom design and content created specifically for your project.
- We retain the right to use generic code, frameworks, and templates across multiple projects.
- We may showcase your completed website in our portfolio unless you request otherwise.
- Third-party assets (fonts, icons, stock images) are subject to their respective licenses.
6. Hosting and Uptime
We strive to maintain high availability for hosted websites. However:
- We do not guarantee 100% uptime and are not liable for occasional downtime.
- Scheduled maintenance will be communicated in advance when possible.
- We maintain regular backups but recommend you keep copies of important content.
7. Limitation of Liability
To the maximum extent permitted by law, LaunchBuddy shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services. Our total liability shall not exceed the amount paid by you for services in the preceding 12 months.
8. Termination
- Monthly plans can be cancelled with 30 days' notice.
- Upon cancellation, we will provide you with a copy of your website files upon request.
- We reserve the right to terminate services for non-payment or violation of these terms.
- No refunds are provided for partial months or one-time setup fees after work has begun.
9. Dispute Resolution
Any disputes arising from these terms or our services shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be subject to the laws of the Province of Ontario, Canada.
10. Changes to Terms
We may update these Terms of Service from time to time. Continued use of our services after changes constitutes acceptance of the new terms.
